SWEEPSTAKES TERMS & CONDITIONS FOR TICKET GIVEAWAY TO PHOENIX, ARIZONA and SACRAMENTO, CALIFORNIA EVENT (hereinafter, “Phoenix & Sacramento Sweepstakes”)

Phoenix & Sacramento Sweepstakes Terms & Conditions: NO PURCHASE NECESSARY TO ENTER OR WIN. The sponsor of the Phoenix & Sacramento Sweepstakes is Bolt Marketing Group, LLC, dba Kids Obstacle Challenge (hereinafter, “Kids Obstacle Challenge”), with its principal place of business at 2505 SE 11th Ave., Ste. 326, Portland, OR 97202.

 

Multiple entries allowed per person (i.e, you may enter multiple times, but you must tag different people for each entry). To enter, you must like the post, tag 2 friends in the comments section, and repost our sweepstakes on either an Instagram story or a post. Complete all three requirements on your personal Instagram account to be qualified to win. Failure to include all required information will void your entry into the Phoenix & Sacramento Sweepstakes. 

Entry period is between October 12, 2018 and October 14, 2018 and will end at 11:59 pm PST. The first winner will receive 5 free tickets to either the Phoenix event on October 20, 2018 (“the Phoenix event”), or the Sacramento event on October 27th, 2018 (“the Sacramento event”), 5 water bottles, and 5 bandanas as their prize. The second winner will receive 3 free tickets to either the Phoenix event or the Sacramento event, 3 water bottles, and 3 bandanas as their prize. The third winner will receive 1 free ticket to either the Phoenix event or the Sacramento event, a water bottle, and a bandana as their prize. The winner must be present at the Phoenix or Sacramento event and pick up the water bottle(s) and bandana(s) at the event. All 9 tickets being given away in this sweepstakes will be to tickets to either the Phoenix, Arizona or Sacramento, California Kids Obstacle Challenge events in 2018. The Phoenix, Arizona event will be held at Rawhide Event Center at 5700 W North Loop Rd, Chandler, AZ 85226. The Sacramento, California event will be held at Gibson Ranch Park at 8556 Gibson Ranch Park rd., Elverta, CA 95626. The 9 tickets are provided by Kids Obstacle Challenge. The Phoenix & Sacramento Sweepstakes is limited to residents of Arizona and California who are at least 18 years of age at the time of entry. Residents of Florida, New York, and Rhode Island are specifically excluded from participating in the Phoenix & Sacramento Sweepstakes. Employees, members, principals, and agents of Kids Obstacle Challenge and its affiliates, and their immediate family members and persons living in the same household, are not eligible to participate in the Phoenix & Sacramento Sweepstakes. 

 

All federal, state, and local taxes and fees associated with the prize are the sole responsibility of the winner. The prize is non-transferable and non-redeemable for cash or exchange. The retail value of the first winner prize is $365. The retail value of the second prize winner is $219, and the retail value of the third prize winner is $73. Those seeking to participate in the Kids Obstacle Challenge event using the tickets will need to review and sign the Waiver of Liability/Indemnification Agreement for the event.

The winner will be selected via a random drawing using Good Random Number Generator on or before October 15, 2018 from all eligible entries received by October 14, 2018, at 11:59 pm PST. The winner will be notified by email or social media channel on or before October 15, 2018 at 11:59 pm PST. Kids Obstacle Challenge is not responsible for late, lost, illegible, misdirected, stolen, undelivered, or separated entries, including if incomplete or inaccurate information is provided on entry forms.

By accepting and/or using the prize, winner agrees to allow Kids Obstacle Challenge to use his or her name, voice, and likeness for the purpose of advertising, trade, or promotion, and allow media coverage at the awarding of the prize without further compensation, unless prohibited by law. If a selected potential winner cannot be contacted, is ineligible, fails to claim the prize, or fails to return the completed and executed declaration and releases as required within the time prescribed, the prize will be forfeited, and an alternate potential winner will be selected. By entering into the Phoenix & Sacramento Sweepstakes, you agree that the Phoenix & Sacramento Sweepstakes Terms & Conditions and the decision of Kids Obstacle Challenge are final and binding in all respects. All applicable federal, state, and local laws and regulations apply. 

Limitation of Liability

Kids Obstacle Challenge and its employees, members, principals, and agents, as well as its affiliates, sponsors, and legal advisors, and their employees, members, principals, officers, directors, and agents (collectively, "Kids Obstacle Challenge and Sponsors”) are not responsible for and shall not be liable for (i) late, lost, illegible, misdirected, stolen, undelivered, or separated entries, including if incomplete or inaccurate information is provided on entry forms and/or if email goes to spam filter; (ii) any condition caused by events beyond the control of Kids Obstacle Challenge and Sponsors that may cause the Phoenix & Sacramento Sweepstakes or selection process to be disrupted or corrupted; (iii) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Phoenix & Sacramento Sweepstakes to the extent permitted by law including without limitation, injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (iv) any printing or typographical errors in any materials associated with the Phoenix & Sacramento Sweepstakes. 

IN NO EVENT WILL KIDS OBSTACLE CHALLENGE AND SPONSORS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR PARTICIPATION IN THE SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THE SWEEPSTAKES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

Arbitration and Disputes

Any controversy or claim arising out of or relating to the Phoenix & Sacramento Sweepstakes shall be settled by mediation or arbitration. If a dispute arises out of or relates to the Phoenix & Sacramento Sweepstake, and if the dispute cannot be settled through negotiation, Kids Obstacle Challenge and participant agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures. If the matter is not resolved within 60 days after initiation of mediation, then, upon notice by either party to the other, the dispute shall be finally settled by arbitration administered by the American Arbitration Association in accordance with the provisions of its Commercial Arbitration Rules. Judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Disputes shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Phoenix & Sacramento Sweepstakes Terms & Conditions, or the rights or obligations of Kids Obstacle Challenge or participant in connection with the Phoenix & Sacramento Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Oregon. Jurisdiction for all disputes shall be Multnomah County, Oregon. Participant understands and agrees that nothing contained in these Phoenix & Sacramento Sweepstakes Terms & Conditions shall be construed so as to require the commission of any act contrary to law, and wherever there is any conflict between any provisions contained in these Phoenix & Sacramento Sweepstakes Terms & Conditions and any present or future statute, law, ordinance, or regulation contrary to which the parties have no legal right to contract, the latter shall prevail; but the provision of these Phoenix & Sacramento Sweepstakes Terms & Conditions which is affected shall be curtailed and limited only to the extent necessary to bring it within the requirements of the law.

Additional Terms 

Kids Obstacle Challenge reserves the right to disqualify any person or entry form that Kids Obstacle Challenge determines to be in violation of any term contained in these Phoenix & Sacramento Sweepstakes Terms & Conditions. Kids Obstacle Challenge reserves the right, in its sole discretion, to suspend or cancel the Phoenix & Sacramento Sweepstakes at any time if tampering, unauthorized intervention, fraud, or other technical problem corrupts the administration, security, or proper execution of the Phoenix & Sacramento Sweepstakes. Sponsors reserve the right to halt or change the selection decision for the Phoenix & Sacramento Sweepstakes at any time due to situations beyond its control, such as strikes, acts of God, etc., or for any reason. In the event of such cancellation, Kids Obstacle Challenge reserves the right to award prizes to another selected and eligible entry. Kids Obstacle Challenge reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Phoenix & Sacramento Sweepstakes. Kids Obstacle Challenge reserves the right to cancel the Phoenix & Sacramento Sweepstakes at any time without obligation or prior notice.
