This Privacy Policy describes how Bolt Marketing Group, LLC, dba Kids Obstacle Challenge (“KOC”) collects and processes your personal information through (1) the KOC website (i.e., https://www.kidsobstaclechallenge.com and affiliated and derivative pages, domains, and websites) (“Website”) and (2) KOC in-person events (“Events”) (collectively, (1)-(2) will hereinafter be referred to as the “KOC Services”).

What Personal Information About Customers Does KOC Collect?

KOC collects your personal information in order to provide and continually improve our products and services.

Here are the types of personal information we collect:

  • Information You Give Us: We receive and store any information you provide arising out of or relating to KOC Services. You can choose not to provide certain information, but then you might not be able to take advantage of many of our KOC Services.

  • Automatic Information: We automatically collect and store certain types of information about your use of KOC Services, including information about your interaction with content and services available through KOC Services. Like many websites, we use "cookies" and other unique identifiers, and we obtain certain types of information when your web browser or device accesses KOC Services and other content served by or on behalf of KOC on other websites.

  • Information from Other Sources: We might receive information about you from other sources, such as updated delivery and address information from our carriers, which we use to correct our records.

 

For What Purposes Does KOC Use Your Personal Information?

We use your personal information to operate, provide, develop, and improve the KOC Services that we offer our customers. These purposes include:

  • Purchase and delivery of products and services. We use your personal information to take and handle orders, deliver KOC Services, process payments, and communicate with you about orders, KOC Services, and promotional offers.

  • Provide, troubleshoot, and improve KOC Services. We use your personal information to provide functionality, analyze performance, fix errors, and improve the usability and effectiveness of KOC Services.

  • Recommendations and personalization. We use your personal information to recommend KOC Services that might be of interest to you, identify your preferences, and personalize your experience with KOC.

  • Comply with legal obligations. In certain cases, we collect and use your personal information to comply with laws. For instance, we collect information for identity verification and other purposes.

  • Communicate with you. We use your personal information to communicate with you in relation to KOC Services via different channels (e.g., email, mail).

  • Advertising. We use your personal information to display interest-based ads for KOC Services that might be of interest to you. We do not use information that personally identifies you to display interest-based ads.

  • Interest-based ads are sometimes referred to as personalized or targeted ads. We show interest-based ads to display KOC Services that might be of interest to you. In providing interest-based ads, we follow the Self-Regulatory Principles for Online Behavioral Advertising developed by the Digital Advertising Alliance (a coalition of marketing, online advertising, and consumer advocacy organizations).

  • What sort of information do we use to show interest-based ads?

    • To serve you interest-based ads, we use information such as your interactions with the KOC Website, content, or KOC Services. We do not use information which on its own identifies you, such as name or email address, to serve interest-based ads.

    • As is common in the advertising industry, we use cookies, pixels, and other technologies (collectively, "cookies"), which enable us to understand the effectiveness of the interest-based ads we show you by measuring what ads are clicked or viewed and to provide you with more useful and relevant ads. For example, if we know what ads are shown to your browser, we can be careful not to show the same ads repeatedly.

  • How do we work with third parties to show you interest-based ads?

    • We work with third parties, such as advertisers, publishers, social media networks, search engines, influencers, ad serving companies, and advertising companies working on their behalf, to improve the relevance of ads we serve. In providing you interest-based ads we do not associate your interactions on unaffiliated sites with information which on its own identifies you, such as name or email address, and we do not provide any such information to advertisers or to third-party sites that display our interest-based ads. Advertisers and other third parties may assume that users who interact with or click on an interest-based ad or content are part of the group that the ad or content is directed towards (for example, users in a particular geographical area or users who purchased or browsed for adventure or fitness). Some third parties may provide us pseudonymized information about you (such as demographic information or sites where you have been shown ads) from offline and online sources that we may use to provide you more relevant and useful advertising.

    • Third party advertisers or advertising companies working on their behalf sometimes use cookies in the process of delivering content, including ads, directly to your browser or Device, and they may automatically receive an IP address when this happens. They may also use cookies to measure the effectiveness of their ads, show you more relevant advertising content, and perform services on behalf of KOC.   • Notifications & Advertising Preferences

  • Fraud Prevention and Credit Risks. We use personal information to prevent and detect fraud and abuse in order to protect the security of our customers, KOC, and others. We may also use scoring methods to assess and manage credit risks.

  • What About Cookies and Other Identifiers?

    • To enable our systems to recognize your browser or device and to provide and improve KOC Services, we use cookies and other identifiers. For more information about cookies and how we use them, please read below.

      • We use cookies, pixels, and other technologies (collectively, "cookies") to recognize your browser or device, learn more about your interests, and provide you with KOC Services and for additional purposes, including:

        • Keeping track of your specified preferences. This allows us to honor your preferences.

        • Keeping track of tickets to Events selected or purchased.

        • Conducting research and diagnostics to improve KOC Services.

        • Preventing fraudulent activity.

        • Improving security.

        • Delivering content, including ads, relevant to your interests on KOC Website and third-party sites.

        • Reporting. This allows us to measure and analyze the performance of KOC Services.

      • KOC’s cookies allow you to take advantage of some of KOC’s essential features. For instance, if you block or otherwise reject our cookies, you may not be able to proceed to purchase a ticket to an Event, or use other KOC products and services that require you to sign in.

      • Approved third parties may also set cookies when you interact with KOC. Third parties include search engines, providers of measurement and analytics services, social media networks, and advertising companies. Third parties use cookies in the process of delivering content, including ads relevant to your interests, to measure the effectiveness of their ads, and to perform services on behalf of KOC.

      • You can manage browser cookies through your browser settings. The 'Help' feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, how to block cookies, and when cookies will expire. If you block all cookies on your browser, neither we nor third parties will transfer cookies to your browser. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some features and services may not work.

 

Does KOC Share Your Personal Information?

Information about our customers is an important part of our business, and we are not in the business of selling our customers’ personal information to others. We share customers’ personal information only as described below.

  • Engagement with Third Parties: We make available to you KOC sponsor information and products through the Website, and may direct you to KOC affiliated businesses (e.g., Rising Wild), if you click on the logos of those sponsors or information about the KOC affiliated businesses or opt to provide your email to learn more about or receive information from them. If you click on those logos or information about the KOC affiliated businesses, you will be re-directed to the websites of those sponsors, and those websites have their own privacy policies. If you opt to provide your email to learn more about or receive information from them, then the personal information you provide will be shared with them. In any case, you can tell when you will be engaging with a third party and opting to share your personal information with them.

  • Third-Party Service Providers: We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders for KOC Services, delivering packages, sending postal mail and email, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments, transmitting content, and providing customer service. These third-party service providers have access to personal information needed to perform their functions but may not use it for other purposes.

  • Business Transfers: As we continue to develop our business, we might sell or buy other businesses or services. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the customer consents otherwise). Also, in the unlikely event that KOC or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.

  • Protection of KOC and Others: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply the Waiver of Liability/Indemnification Agreement, and other agreements; or protect the rights, property, or safety of KOC, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

  • Other than as set out above, you will receive notice when personal information about you might be shared with third parties, and you will have an opportunity to choose not to share the information.

 

How Secure Is Information About Me?

We design our systems with your security and privacy in mind.

  • We work to protect the security of your personal information during transmission by using encryption protocols and software.

  • We use Square, which complies with all required PCI standards, for all credit card transactions and to handle all credit card data. Click here to learn more about the Security at Square.

  • We maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

  • It is important for you to protect against unauthorized access to your password and to your devices. Be sure to sign off when finished using a shared computer and close out of the browser. 

 

What About Advertising?

  • Third-Party Advertisers and Links to Other Websites: KOC Services may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services.

  • Use of Third-Party Advertising Services: We provide ad companies with information that allows them to serve you with more useful and relevant KOC ads and to measure their effectiveness.

You can access your information, including your name, address, and payment options by emailing us at info@kidsobstaclechallenge.com.

What Choices Do I Have?

If you have any questions as to how we collect and use your personal information, please contact us at info@kidsobstaclechallenge.com. Many of our KOC Services also include settings that provide you with options as to how your information is being used.

  • As described above, you can choose not to provide certain information, but then you may not be able to take advantage of many of the KOC Services.

  • You can add or update certain information on pages such as those referenced in the What Information Can I Access section above. When you update information, we usually keep a copy of the prior version for our records.

  • If you do not want to receive email or other communications from us, please update your preferences or unsubscribe from our email list, but please know that if you do so you may miss out on important communications from us, such as communications relating to Events.

  • If you do not want to see interest-based ads, typically, you can click the “X” at the top right of the ad or adjust your settings or preferences on your social media accounts, and you can notify us at info@kidsobstaclechallenge.com.

  • The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new cookies or other identifiers, how to have the browser notify you when you receive a new cookie, or how to block cookies altogether. Because cookies and identifiers allow you to take advantage of some essential features of KOC Services, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you may not be able to proceed to buy a ticket to an Event, or use other KOC services that require you to sign in.

  • If you want to browse the Website without linking the browsing history to your account, you may do so by logging out of your account and blocking cookies on your browser.

  • You will also be able to opt out of certain other types of data usage by updating your settings on your devices. For most devices, these controls are located in the device's settings menu. If you have questions about how to change your device permissions, we recommend you contact your mobile service carrier or your device manufacturer(s).

  • In addition, to the extent required by applicable law, you may have the right to request access to or delete your personal data. If you wish to do any of these things, please contact info@kidsobstaclechallenge.com. Depending on your data choices, certain services may be limited or unavailable.

 

Are Children Allowed to Use KOC Services?

KOC does not sell KOC Services for purchase by children. We sell KOC Services for purchase by adults. If you are under 18, you may use KOC Services only with the involvement of a parent or guardian. We do not knowingly collect personal information from children under the age of 13 without the consent of the child's parent or guardian.

  • KOC Events are intended not only for children but for people of all ages. Parents or legal guardians who purchase a ticket for their child(ren) may provide information about their children (e.g., first and last name, age, and address), and KOC may deliver mail or packages to the names of those children.

  • We may know that a child is participating in an Event, including a competitive wave at an Event, when the parent or legal guardian checks in the child at registration on the day of the Event. Except for results from the competitive wave, no personal information is posted about the child. As for the competitive wave at an Event, the first name and first initial of the last name, along with the competitive wave time, may be posted at the Event and through KOC’s social media accounts.

  • In any case, only with verifiable parental consent under the Children’s Online Privacy Protection Act do we collect personal information of a child (“Child Personal Information”). Depending on the what information the parent or legal guardian provides when purchasing a ticket or at check in at an Event, Child Personal Information could include, for example, name; birthdate; address; voice, photos, or videos, as set forth in the Right to Use Likeness section of the Waiver of Liability/Indemnification Agreement.

  • KOC does not require the disclosure of Child Personal Information to participate in an Event, but if such information is provided, KOC does not require more information than is reasonably necessary to participate in the Event.

  • At any time, a parent or legal guardian, by contacting info@kidsobstaclechallenge.com, may review their child’s Child Personal Information, direct KOC to delete it, and refuse to allow any further collection of their child’s Child Personal Information.

  • At any time, a parent or legal guardian, by contacting info@kidsobstaclechallenge.com may agree to KOC’s collection and use of their child’s information but not allow disclosure of it to third parties. For example, a parent or legal guardian can decide that deliveries should be addressed to the parent or legal guardian, and not in the child’s name, in which case that Child Personal Information would not be provided to the third party handling the deliveries.

 

California Consumer Privacy Act

Please read below regarding additional disclosures required under the California Consumer Privacy Act.

This California Consumer Privacy Act disclosure page ("Disclosure") supplements the Privacy Policy and is effective as of January 1, 2020. The Privacy Policy describes the personal information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. These additional disclosures are required by the California Consumer Privacy Act:

  1. Categories of personal information collected. The personal information that KOC collects, or has collected from consumers in the twelve months prior to the effective date of this Disclosure, fall into the following categories established by the California Consumer Privacy Act, depending on which KOC Services is used:

    • identifiers such as your name, alias, address, phone numbers, or IP address;

    • personal information, such as a credit card number;

    • age, gender, or other protected classifications, for example if you signed your child up for an Event;

    • commercial information, such as purchase activity;

    • Internet or other electronic network activity information, including content interaction information, such as downloads;

    • geolocation data, such as the location of your device or computer;

    • audio or visual information, such as images and videos submitted in connection with KOC Services; and

    • inference data, such as information about your purchase preferences.

  2. Categories of personal information disclosed for a business purpose. The personal information that KOC disclosed about consumers for a business purpose in the twelve months prior to the effective date of this Disclosure fall into the following categories established by the California Consumer Privacy Act, depending on which KOC Services is used:

    • identifiers such as your name, address, phone numbers, or IP address, for example if we use a third-party carrier to deliver your order;

    • personal information, such as a credit card number, for example if we use a third-party payment processor;

    • your age, gender, or other protected classifications, for example if you choose to participate in a survey distributed by a survey provider;

    • commercial information, such as the details of a ticket you purchased if a third-party service provider is assisting to provide that product or service to you;

    • internet or other electronic network activity information, such as if we use a service provider to help us gather crash reports for analyzing the health of our services; and

    • professional information, for example if we provide your account details to a service provider for verification as part of the purchase of a ticket.

  3. Right to Request Access to or Deletion of Personal Information: You may have the right under the California Consumer Privacy Act to request information about the collection of your personal information by KOC, or access to or deletion of your personal information. If you wish to do any of these things, please contact KOC at info@kidsobstaclechallenge.com. Depending on your data choices, certain services may be limited or unavailable.

  4. No sale of personal information. In the twelve months prior to the effective date of this Disclosure, KOC has not sold any personal information of consumers, as those terms are defined under the California Consumer Privacy Act.

  5. No Discrimination. KOC will not discriminate against any consumer for exercising their rights under the California Consumer Privacy Act.

 

Waiver of Liability/Indemnification Agreement

If you choose to use KOC Services, your use and any dispute over privacy is subject to this Privacy Policy and our Waiver of Liability/Indemnification Agreement, including limitations on damages, resolution of disputes, and application of the law of the state of Oregon. If you have any concern about privacy at KOC, please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Policy will change also. You should check the Website frequently to see recent changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
